NYWBA LGBT, Children’s Rights and Matrimonial
and Family Law Committees

presents the following CLE program

“Beyond Brooke B: Litigating Same Sex
Parenting Cases in the New Legal Landscape”

Hosted by
JAMS Matrimonial and Family Law Neutrals,
Caroline Antonacci, Esq. and Hon. Betty Ellerin (Ret.)

Moderator:

Hon. Ellen Gesmer, Associate Justice of the Appellate Division for the First Department

Speakers:

Eric Wrubel, Partner at Wrubel Burstein, LLP
Margaret Canby, Partner at Blank Rome LLP
Peter Favaro, Ph.D.

The speakers will be exploring the legal landscape with the demise of the Bright Line rule enunciated in Alison D. Specifically, the speakers will discuss different ways to establish the pre-conception agreement and what other standards may be available for parents. In addition, the speakers will propose protocols for the re-introduction of the parent who has been barred access to their child. Lastly, the speakers will discuss the emergence of children’s rights—separate and apart from those of the parents—and how the Court of Appeals recognized those rights in the Brooke B. decision.
