This virtual program will examine the constitutional limits on the use of force by federal law enforcement, including ICE and Customs & Border Patrol, and whether their actions may violate individual rights under federal and state law. The program will explore current legal standards, assess available civil and criminal remedies, and consider potential reforms to address gaps in accountability and protection.

Debra S. Cohen, Esq.
Ms. Cohen is co-chair of Newman Ferrara LLP’s Civil Rights Practice Group. She is an adjunct professor of law at Pace University’s Haub School of Law teaching Civil Rights Law and Civil Rights Litigation. Ms. Cohen, along with her law partner Randolph McLaughlin, has litigated many cases involving constitutional violations by law enforcement. She is the co-chair of WBASNY’s ERA/Civil Rights Committee and the NYWBA’s delegate to WBASNY’s Legislation Committee.
Bennett L. Gershman, Esq.
University Distinguished Professor Bennett Gershman has been a professor of law at Haub since its founding in 1976. He previously served as a prosecutor in the New York State Anti-Corruption office arguing cases in state and federal courts. Professor Gershman is a nationally recognized expert in prosecutorial misconduct and is the author of many books and articles on the subject. Professor Gershman teaches courses in Constitutional Law, Criminal Procedure and Evidence.
Randolph M. McLaughlin, Esq.
Randolph McLaughlin is a professor of law at Haub teaching Civil Procedure, Labor Law and Torts. He is also co-chair of Newman Ferrara LLP’s Civil Rights Practice Group. Professor McLaughlin began his legal career at the Center for Constitutional Rights where he pioneered legal strategies to redress racially motivated violence. He is a recognized expert in the field of voting rights, having successfully litigated cases throughout New York State.
